What if there is a conflict between my lease and the law? Generally, if there is a conflict between your lease and the law, the law takes precedence. For example, your lease may state that your landlord can evict you for any reason. However, California law states that a landlord must have a just cause to evict a tenant. In this situation, California law takes precedence. Your landlord cannot evict you without a just cause, even if your lease says they can. Another example: Your lease may state that you cannot have any pets. However, if you have a service animal or an emotional support animal, your landlord must make a reasonable accommodation for that animal. In this situation, the law takes precedence. Your landlord must allow you to have your service animal or emotional support animal, even if your lease says you cannot have any pets. If you have questions about whether a term in your lease is legal, you should contact an attorney.
